Drug Manufacturing Law in Texas
The Texas Controlled Substances Act defines manufacturing as the “production, preparation, propagation, compounding, conversion or processing” of any of the substances the Texas Legislature has made into controlled substances. Marijuana is not technically considered a part of this definition, but it is also a criminal offense to grow or cultivate cannabis. The definition does include extracting natural ingredients to form a controlled substance or chemically synthesize a controlled substance. Manufacturing also includes packaging, repackaging, labeling or relabeling narcotics.
Drug manufacturing includes meth labs. Meth is produced with chemicals that give off heavy fumes and can be explosive, hence meth labs are often in isolated places. Bell County and Williamson County include many such areas.
As mentioned, marijuana is not technically included in the Texas Controlled Substances Act’s definition of drug manufacturing. However, being accused of cultivating marijuana or cannabis, whether in a growhouse, a hydroponic setup or in a potted plant, could carry heavy penalties.
